Backround​ of Khyber Pakhtunkhawa Regulatory Authority

Treatment and outcomes of end stage organ failure has considerably improved due to progress made in the realm of solid organ transplantation over the last two decades. In global perceptive organ donations are either live related or harvested from deceased donor. However increasing number of patients requiring organ donation has led to an imbalance between demand and supply of organs.

Resultantly, the poor and underprivileged people from underdeveloped and developing countries became victims of organ trafficking. To address this issue, Istanbul Declaration was signed on 8th May, 2008 calling for a total ban on organ trafficking and transplant tourism. Live related organ donations has emerged as the most popular means of supply of organs in the Western World followed by the organ donation from deceased persons. In contrast deceased organ donation has not been popularized in the Muslim World because of lack of facilities in some countries and reluctance of organ donations due to religious, social and/or cultural reasons.

Pakistan unfortunately gained popularity from sale of organs retrieved from the very poor and under privileged and became expedient because of organ trafficking and was dubbed as “Kidney Bazaar” which was undoubtedly bringing bad name to our country. In light of the above and followed by the intervention of Honorable Supreme Court of Pakistan, organ trafficking was criminalized in Pakistan in 2007 by The Transplantation of Human Organs and Tissues Ordinance 2007, followed by The Transplantation of Human.

Organs and Tissue Act 2010.In 2014, the Government of Khyber Pakhtunkhwa passed an Act called “The Khyber Pakhtunkhwa Medical Transplantation Regulatory Authority Act, 2014” and the Khyber Pakhtunkhwa Medical Transplantation Regulatory Authority was established in April, 2016. The Regulatory Authority aims to regulate, control and monitor all human organ transplantation and the various committees constituted under the Act ibid.

Achivements

  • The  Regulatory  Authority  has  been  established  under the Act and made functional.
  • The Regulatory  Authority  is  Performing its  functions as  per Khyber Pakhtunkhwa Medical Transplantation Regulatory  Authority  Act, 2014 & the rules  made thereunder i-e The Khyber Pakhtunkhwa Medical Transplantation regulatory Authority Rules, 2017
  • Statutory  Committees  under the Act have been notified and fully functional.
  • Recommendations of committee are regularly reviewed and monitored
  • Kidney Transplant – 421 Transplant
  • Corneal Transplant – 450 Transplant
  • Bone Grafting – 41 Transplant
  • Paired Organ Exchange Program initiated.
  • Awareness campaigns have been organized.

Established a Provincial Registry at head office level.

Vigilance committees at the District level have been approved. The said committees shall be headed by the Deputy Commissioner and shall include District Police Officer, Officer from Special Branch, FIA & KP-MTRA.

Recipient Registry has been established at hospitals level.

  • Bone bank at Northwest General Hospital has been established.
  • Working on centralized Eye bank under process.

Established a Liaison with international organ donation Agencies

  • Established a complaint management system under the Regulatory Authority for immediate and prompt response.
  • Disposal of complaints through Transplant Inquiry Committee.

Constituted a forum/committee for deceased organ donation.

  • World Kidney and Transplant day is organized every year by the Regulatory Authority.
  • Success stories are shared by donors and recipients, media is invited, awareness walk is conducted in coordination with KMU , HCC, FIA & IKD
  • Human Organ Transplant Authority-HOTA Network has been extended  to Khyber Pakhtunkhwa Medical Transplantations Regulatory Authority Act, 2014 passed through Provincial Assembly.
  • The Khyber Pakhtunkhwa Medical Transplantation Regulatory Rules, 2017 framed and notified.
  • Different Committees constituted.
  • Necessary actions and initiative taken to eliminate the sale of human organs.
  • Necessary amendment in Act has been done through Provincial Assembly in 2021 and Amended Act namely the Khyber Pakhtunkhwa Medical Transplantation Regulatory Authority (Amendment) Act, 2021 passed.
  • Further amendments will be done as per requirement and in process
  • Regular data collection is enacted and is evaluated by the team of experts.
  • Regular follow up of recipient and donor is in practice to examine the quality and outcome of transplant centers.
  • Constituted Committees at Regional level for regular monitoring and follow up to evaluate outcomes.
  • Established Provincial set up and office at Peshawar.

Actions in association with law enforcement agencies (FIA) have been taken to curb down sale of human organ.

Initiated the donors cards.

Disposed off all pending litigation cases.

  • Constituted the Committee on Cornea Procurement.
  • Framing of rules for Procurement of cornea are in the process of development.
  • Achieved the desired outcomes through implementation of the Prescribed standards.
  • Physical inspection and verification conducted through Transplant Monitoring Committee

Duties and responsibilities of the transplant surgeons and physicians are closely monitored in accordance with the prescribed rules.

  • Letters with Registration forms circulated to all hospitals.
  • Regular review of donation is performed , proper NOCs/approval is issued in each donation.
  • Transplant data is regularly collected and evaluated to examine the outcomes of transplant centers.
  • Fee structure for Registration, renewal and processing fee has been developed and approved.
  • Fee structure is reviewed and revised from time to time.
